This Policy is to inform you of the policies and procedures regarding the collection, use and disclosure of personal information we receive from users of the Nebraska Passport App, as controlled by the Nebraska Tourism Commission. This policy applies to all users who create an account on the Nebraska Passport App.

To set up an account on the Nebraska Passport App, we ask you for personally identifiable information. This refers to information about you that can be used to contact or identify you (“Personal Information”). Personal Information includes, but is not limited to, your name, username, phone number, email address, shipping address, and birthdate.

Any information you provide will NOT be sold to any third party. See “Disclosures of Information” section.

Uses of Information

Shipping address is collected because any prizes you earn through participating in the Nebraska Passport Program will be mailed to you. Phone number and email address are collected in case the Nebraska Tourism Commission needs to contact you regarding your participation in the Nebraska Passport Program, including questions about your prize entry. Birthdate is collected in order to determine if you qualify for certain prizes; you must be 19 years or older on October 2, 2018 to receive prizes containing Nebraska Lottery coupons.

You can choose not to provide us with any or all of the information we specify or request, but then you will not be able to register an account with us because we will not be able to administer your account, which includes shipping your earned prizes.

Disclosures of Information

Please be advised that all information which is collected by state agencies is likely to be considered a public record which is available for public review under the Nebraska Public Records Statutes unless there is a specific statute which allows that information to be kept confidential. An example of a specific statute which allows certain types of information to be kept confidential may be found at Neb. Rev. Stat. Section 84-712.05.

The Nebraska Passport App is maintained by a private company, Nanonation. Data gathered through the App, or through portals or data interchanges maintained by the Commission and submitted to state agencies are government records subject to the same rules of access and disclosure as they would be if submitted in paper form. As stated elsewhere in this notice, the general rule under Nebraska public records law is that all government records are open to public inspection unless expressly exempt from that requirement by law.

We may employ third party companies and individuals to facilitate our App, to provide the App on our behalf, to perform App-related services (e.g., without limitation, maintenance services, database management, improvement of the App’s features) to assist us in analyzing how our App is used, or to perform other services (e.g. providing customer service). These third parties have access to your Personal Information only to perform these tasks on our behalf.

The Commission may cooperate with other government and law enforcement officials and private parties to enforce and comply with applicable law. We may disclose any information about you to government or law enforcement officials or private parties as we believe necessary or appropriate to respond to claims and legal process (including, but not limited to, subpoenas), to protect the property and rights of the Commission or a third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable activity.


The Commission takes reasonable precautions to keep your personal information secure and has put in place appropriate physical, electronic, and managerial procedures to safeguard the information collected through the App. Due to the nature of the Internet, however, the Commission cannot guarantee the security of any information you disclose online, and you do so at your own risk.

We may make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this App in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.
